Loyalty Rewards, Coupons and app Entitlements

Introduction

Otto’s Service Pty Ltd (“Otto’s Market”) operates one of North Queensland’s largest integrated fresh food businesses.  Otto’s has a number of departments trading under the Otto’s Market brand, including Otto’s Fish Market, Otto’s Continental Deli, Otto’s Meat Market and more.

 

We value our customers and wish to consistently reward them through our Friends With Benefits loyalty program (“Program”) whenever they purchase from our retail stores and participating departments.

 

 

Friends With Benefits Program

These terms and conditions apply to each customer who is a member of the Program (each a “Friends With Benefits Member”).

 

Only natural persons residing in Australia can be Friends With Benefits Members. Program membership cannot be held jointly.

 

Otto’s Market may refuse any application for membership in its sole and absolute discretion.

 

By completing an enrolment form; by downloading the app; by providing verbal consent to participate in the Program as a Friends With Benefits Member; or by claiming a benefit or reward under the program, a person will be taken to accept these Terms and Conditions (as amended from time to time) and agree to be bound by them.

 

 

Printed Coupons and App Entitlements
Claimants agree to be bound by these Terms and Conditions. Claimants must comply with these Terms and Conditions for a Printed Coupon to be valid.

 

Each claimant is entitled to one Coupon per item (item named on the Coupon). Printed Coupons are not transferable and are not redeemable for cash, however may be combined with Printed Coupons and App Entitlements for additional items offered by Otto’s Market.

 

Individual Printed Coupon and App Entitlement discounts are available for single use redemption only. Credit or change will not be given for unused amounts. Unused discount amounts will expire immediately upon partial redemption of a Printed Coupon or App Entitlement.

 

Each App Entitlement is identified by a code. The claimant is being bound by the conditions linked to the redemption of the App Entitlement.

 

Each Printed Coupon is identified by a text and offers a different discount. The claimant is being bound by the conditions linked to the redemption of the Coupon.

 

Printed Coupons and App Entitlements are redeemable in store at Otto’s Market Precinct and Otto’s Market Warrina. They are not redeemable online.

 

To redeem a Printed Coupon, the claimant presents the Printed Coupon to the register staff at point of sale. The relevant discount will be deducted from the final price of the qualifying purchase. If the claimant fails to surrender the Printed Coupon code at the time of purchase, the purchase will not be eligible for the discount. Discounts may not be claimed after a sale has been finalised.

 

To redeem an App Entitlement, the claimant presents their in-app QR entitlement code to the register staff at point of sale OR places an order via the app. The code will be scanned, and the relevant discount will be deducted from the final price of the qualifying purchase. If the claimant fails to utilise the code at the time of purchase as specified, the purchase will not be eligible for the discount. Discounts may not be claimed after a sale has been finalised.

 

Each Coupon and App Entitlement is valid for a limited time only and expires at the time specified in Otto’s Market marketing communications.

 

A Printed Coupon or App Entitlement cannot be applied to bookings, orders or sales retrospectively.

 

If a Printed Coupon or App Entitlement is used and a booking, order or sale is cancelled or refunded at a later stage by the claimant, the Printed Coupon or App Entitlement will no longer be valid.

 

Printed Coupon and App Entitlement discounts applied to sales cannot be refunded.

 

Otto’s Market shall not be liable for any loss, damage or injury suffered or sustained (even if caused by negligence) as a result of accepting and/or using a Printed Coupon or App Entitlement, except for any liability which cannot be excluded by law.

 

Otto’s Market accepts no responsibility for late, lost or misdirected email or other communications. Otto’s Market assumes no responsibility for any failure to receive a claim or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then Otto’s Market may modify, cancel, terminate or suspend the Printed Coupon or App Entitlement.

 

Otto’s Market reserves the right to discontinue a Printed Coupon or App Entitlement at any time.

 

 

Privacy Collection Notice

Otto’s Market (or agents acting on its behalf) collects personal information from Friends With Benefits Members to administer the program, to properly account for accrued spend and other benefits, and for direct marketing. If personal information is not provided, customers may not receive all of the benefits and rewards of the Program (and, in some cases, customers may not be eligible to participate in the Program). Otto’s Market’s full Privacy Policy is available at ottosmarket.com.au/privacy and includes information about how a Friends With Benefits Member may access and correct his or her personal information or make a complaint about privacy.

 

By completing an enrolment form (via the Otto’s Market app or online) or providing verbal consent to participate in the program as a Friends With Benefits Member, a person consents to Otto’s Market (and its agents and contractors) using and disclosing their personal information for the purposes of direct marketing of goods and services. Direct marketing communications may be made by email, SMS, push notifications, social media or by regular post. A Friends With Benefits Member may ‘opt out’ of direct marketing communications at any time by contacting Otto’s Market via email at [email protected].

 

Keen Beans Coffee Scheme

Otto’s Market app users are eligible to participate in the Keen Beans Coffee Program. When a Member purchases any tea or coffee from Otto’s Monsooned Espresso Bar, at Warrina, Precinct, JCU or via the ordering app, the purchase will count toward their Keen Beans Coffee Scheme tally. When a member purchases their 10th coffee, the Member will receive a complimentary medium coffee voucher via the app, SMS or email. The voucher must be redeemed within 28 days and is not valid in conjunction with any other offer.

 

 

Loyalty Rewards and Other Benefits

Otto’s Market will make benefits and rewards available to Friends With Benefits Members from time to time (whether generally or specifically to particular program tiers). Such benefits and rewards may be withdrawn, amended or substituted from time to time. Benefits and rewards may be communicated via email, SMS, push notifications, social media or regular post. Unless otherwise specified, benefits and rewards are not transferrable and not redeemable for cash (or other value, such as gift cards). Expiry dates on all benefits and rewards are final.

 

Friends With Benefits Members may also be given the opportunity to receive offers, special discounts and enter into competitions (“Offers”). Offers are subject to further terms and conditions, the details of which will be available at the time of each offer. Offers may be communicated via email, SMS, push notifications, social media or regular post.

 

Discounts made available for Friends With Benefits Members from time to time apply only to full-priced items sold by Otto’s Market and its participating departments, and are not available in conjunction with any other offer, unless otherwise specified.

 

 

General Terms and Conditions

Each Friends With Benefits Member must provide an email address or phone number in order to participate in the Program. However, a Friends With Benefits Member may ‘opt out’ of direct marketing communications at any time by contacting Otto’s Market using the contact details below.

 

A Friends With Benefits Member may cancel his or her membership at any time by notice to Otto’s Market at the contact details below. In the event of cancellation, all accrued spends, benefits and rewards will be automatically cancelled and forfeited.

 

Any failure by a Friends With Benefits Member to adhere to these Terms and Conditions may result in termination of a Friends With Benefits membership in the Program and the automatic cancellation and forfeiture of accrued spend and other benefits and rewards.

 

Otto’s Market may terminate the Program at any time. In the event of termination of the Program, Otto’s Market will notify Friends With Benefits Members of the termination of the Program. All benefits and rewards must be redeemed within 28 days of the date of termination. All accrued spends and other rewards and benefits which are not redeemed will be forfeited.

 

Otto’s Market will use reasonable endeavours to transmit notices relevant to the administration of the Program to each Friends With Benefits Member in accordance with his or her communications preferences. Any notice will be deemed to have been given if posted to the mailing address or emailed to the email address last notified by the Friends With Benefits Member. Each Friends With Benefits Member is responsible for notifying Otto’s Market of any change to their contact details or communications preferences. Otto’s Market will not be liable for an accidental failure to deliver (or the non-receipt of) a notice.

 

Otto’s Market will not be liable for any disruption to the Program or any delay in providing, or inability to provide, any of the benefits of the Program which is caused by circumstances beyond the control of Otto’s Market (including but not limited to strikes or industrial disputes, acts of God, flood, weather, aircraft unserviceability or unavailability, war or civil disturbance).

 

All Friends With Benefits loyalty cards (“Otto’s Cards”) remain the property of Otto’s market. Otto’s Market is not responsible for stolen or lost Otto’s Cards.

Any claimed discrepancy in relation to accrued spend must be notified in writing by the Friends With Benefits Member to Otto’s Market, together with a legible copy of any relevant proof of purchase (ie a tax invoice). In the case of dispute, the decision of Otto’s Market will be final and binding.

 

To the fullest extent permissible by law, Otto’s Market will not be liable for any loss suffered by a Friends With Benefits Member arising in connection with their membership in the Friends With Benefits Program. Nothing in these terms and conditions is to be read as excluding, restricting or modifying the application of any legislation by which law cannot be excluded, restricted or modified or limiting the rights of any person under the Australian Consumer Law.

 

Any dispute regarding the eligibility to participate in the Program; accrual or redemption of points; eligibility for any benefit or reward; or any other dispute which arises in connection with a Friends With Benefits Member’s participation in the Program will be determined by Otto’s Market in its sole and absolute discretion.

 

These Terms and Conditions may be changed, amended or varied at any time by Otto’s Market without giving a reason by giving notice to Friends With Benefits Members. Without limiting any other means of giving notice, Otto’s Market may give notice of an amendment to these terms and conditions by publishing a notice on the Otto’s Market website: ottosmarket.com.au/terms-and-conditions.
